Welcome to PushScreen! We're glad you're here. By using our mobile application (the "App"), you are entering into a legally binding agreement with its developer, Mikalai Ptahyts ("we," "us," or "our").

Please review these Terms carefully. If you do not agree with them, do not use the App.

1. The PushScreen Service

PushScreen is designed to help you build healthy habits by linking exercise (push-ups and other workouts) to app access. Here's how it works:

• You select which apps you want to manage and set time limits.
• The App uses your device camera to detect and count exercises (like push-ups) in real-time. Video is processed locally and never saved.
• Completing exercises earns you time to use your selected apps.
• The App uses Apple's Screen Time API (Family Controls) to monitor app usage and enforce time limits.
• When your time runs out, selected apps are blocked until you complete more exercises.

We do our best to ensure the App runs smoothly; however, it is provided on an "as is" basis. This means we cannot guarantee it will be constantly available or free of errors.

2. Your License to Use PushScreen

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes. You may use it on any iPhone or iPad that you own or control, as permitted by the App Store's rules.

This means you agree not to:

• Distribute, sell, rent, or otherwise transfer the App to third parties.
• Copy, decompile, reverse-engineer, or attempt to derive the source code of the App.
• Use the App for any illegal or unauthorized purpose.
• Attempt to circumvent or disable the app blocking functionality.
• Use automated tools to manipulate exercise detection.

3. Subscriptions

The App offers auto-renewable subscriptions to access premium features:

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing and Canceling: You can manage and cancel your subscriptions at any time by going to your account settings in the App Store after purchase.
• Refunds: A cancellation will take effect at the end of the current billing period. We do not provide refunds for any unused portion of a subscription period, in accordance with App Store policy.

4. Screen Time & Family Controls

By using PushScreen's app blocking features, you acknowledge and agree that:

• The App requires access to Screen Time permissions to monitor and block selected apps.
• You grant this permission voluntarily and can revoke it at any time in iOS Settings.
• We only monitor apps you explicitly select for blocking.
• We do NOT collect or access the content of apps you use, your browsing history, or any personal data from those apps.
• App blocking may prevent access to important apps if you run out of time. You can always disable blocking or delete your account in Settings.

5. Camera Usage

PushScreen uses your device camera exclusively to detect and count exercises (push-ups, squats, etc.). Video is processed in real-time on your device using computer vision technology (MediaPipe) and is never saved, recorded, stored, or transmitted anywhere. We cannot access or view your camera feed.

6. Your Data & Privacy

You are responsible for the security of your account information. Your privacy is paramount to us. We collect and use your data only as described in our Privacy Policy.

Key points:

• We never sell your data to third parties.
• Camera video is processed locally and never leaves your device.
• App usage data is kept private and used only to enforce your time limits.
• You can delete your account and all data at any time.

7. Health & Exercise Disclaimer

Important: PushScreen is a productivity and habit-building tool, not a medical or fitness device.

• Consult a healthcare professional before starting any exercise program.
• Exercise counts may not be 100% accurate. Use your judgment and listen to your body.
• We are not liable for any injuries or health issues that may result from exercising while using the App.
• Stop exercising immediately if you experience pain, dizziness, or discomfort.

8. No Warranties

PushScreen is provided "as is". This means:

• We don't guarantee continuous availability or flawless functionality.
• Exercise detection accuracy may vary based on lighting, camera angle, and other factors.
• App blocking features depend on iOS Screen Time APIs and may be affected by system updates.
• We're not responsible for data loss or any damages resulting from PushScreen's use.

We do our best to ensure PushScreen runs smoothly and securely.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Ending This Agreement

You can stop using PushScreen at any time by deleting the App from your device and deleting your account from Settings. We reserve the right to suspend or terminate your access to the App if you violate these Terms.

11. Important Legal Provisions (App Store Requirements)

As an app distributed through the App Store, we are required to include the following terms in our agreement with you:

• Acknowledgement: This Agreement is between you and Mikalai Ptahyts only, not with Apple Inc. ("Apple"). We are solely responsible for the PushScreen App and its content.
• Maintenance and Support: We are responsible for providing any support for the App. Apple has no obligation to provide any maintenance or support services.
• Warranty: We are solely responsible for any product warranties. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation whatsoever with respect to the App.
• Product Claims: We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal compliance, or consumer protection claims.
• Intellectual Property Rights: If a third party claims that our App infringes their intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such a claim.
• Legal Compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple as a Third-Party Beneficiary: You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of these terms, Apple will have the right to enforce this Agreement against you.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Effective Date" at the top of the page. If the changes are significant, we'll let you know in the app or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your country of residence, without regard to its conflict of law provisions.
